Rape Is Fine, As Long As You’re Asleep

A Belgian man has walked free after raping his daughter in his sleep. Because there was no evidence he was awake, there was a reasonable doubt he was asleep and not in control of his actions.

What a shame the courts ignored common sense and instead relied on the testimony of paid experts to understand this novel defense.

The man claimed that he has sexsomnia, a condition where people engage in sexual practices while sleeping. They often do things they would not while awake and have no recollection of the events afterwards.

His lawyer said: “My client has had sleep problems for a long time. When he was living with the girl’s mother he often had sex with her in his sleep.

“He could not remember what happened with his daughter the next day. He is deeply sorry. But he could do nothing about it. He was powerless.”

Obviously there is no way of telling whether the father is telling the truth or not, but even giving him the benefit of the doubt he should be behind bars.

If he knew he has sexsomnia and chose to sleep in the same room as his daughter, exposing her to the possibility of being raped by her dad, then at best he is a grossly negligent parent.

It’s great that courts are no longer turning a blind eye to sexual abnormalities, but they should also not forget basic common sense. It doesn’t take an expert to explain that exposing your daughter to the possibility of rape is a criminal act.
